1. Agreement to these terms
These Terms and Conditions ("Terms") govern access to and use of the BabyBrain iOS and iPadOS application, related content, and the BabyBrain website (together, the "Service"). By downloading, purchasing, accessing, or using the Service, the adult responsible for the device agrees to these Terms and the Privacy Policy.
If you do not agree, do not purchase or use the Service. If you allow a child to use BabyBrain, you accept these Terms on your own behalf and are responsible for the child's supervised use.
2. Service provider
BabyBrain is provided by ARCHIMEDES.VISION E.E., established in Greece ("ARCHIMEDES.VISION", "we", "us", or "our").
3. Adult responsibility and parental supervision
BabyBrain is intended to be selected, configured, purchased, and supervised by a parent or legal guardian. A child should not access purchase controls, external links, subscription management, legal information, or support communication without an adult.
- You must be legally capable of entering a contract and authorized to use the Apple Account and payment method used for any purchase.
- You are responsible for selecting an appropriate development stage, session duration, physical environment, and activity.
- You must actively supervise the child, keep the device physically safe, and stop play if the child shows distress, fatigue, discomfort, frustration, or unsafe behavior.
- You are responsible for following applicable professional guidance on sleep, physical activity, sedentary behavior, vision, accessibility, and screen use.
4. Educational purpose and important limitations
BabyBrain is an educational play product, not a medical device or healthcare service.
The Service is designed to offer short, intentional activities involving attention, coordination, memory, matching, early language, number familiarity, and simple problem-solving. Descriptions of a game's intended play value are not clinical claims.
BabyBrain does not diagnose, prevent, monitor, treat, or cure any medical, developmental, neurological, psychological, visual, motor, speech, or learning condition. It is not a substitute for professional assessment, therapy, medical advice, school instruction, sleep, physical activity, outdoor play, reading, or responsive parent-child interaction.
Children develop at different rates. We do not promise faster development, a particular milestone, school readiness, therapeutic benefit, or any specific result. Parents with concerns about a child's development or health should consult a qualified healthcare professional.
5. App license and Apple terms
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use BabyBrain on Apple-branded devices that you own or control, in accordance with applicable App Store usage rules.
The app is licensed, not sold. These Terms supplement Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"). If a provision of these Terms conflicts with mandatory App Store terms, the applicable App Store term controls to the extent of that conflict.
Apple is not responsible for maintaining or supporting BabyBrain. Apple and its subsidiaries are third-party beneficiaries of the app-license provisions and may enforce them as permitted by the Apple Standard EULA.
6. Free access and premium subscriptions
BabyBrain may provide limited features without payment and offer premium access to features identified on the App Store purchase screen. The intended euro subscription options are:
Prices above are reference prices for euro storefronts. The localized price, currency, tax treatment, duration, included premium features, and any introductory offer shown in Apple's purchase confirmation sheet at the time of purchase are the binding offer. Prices may differ by country or region.
Subscriptions provide access for the selected billing period and automatically renew for periods of the same duration unless cancelled before the renewal date. We will clearly identify premium content and provide ongoing value consistent with Apple's subscription requirements.
7. Apple billing, renewal, cancellation, and refunds
- Payment: all purchases are processed by Apple through In-App Purchase and charged to the Apple Account confirmed at purchase. We do not receive card or bank details.
- Automatic renewal: Apple renews the subscription at the then-applicable price unless it is cancelled before the renewal date shown in Apple subscription settings.
- Cancellation: the Apple Account holder can cancel at any time through Settings or the App Store. Cancellation normally takes effect at the end of the current paid period; access generally continues until then.
- Trials and offers: if Apple displays a free or discounted trial, its length and post-offer renewal price will appear before confirmation. To avoid renewal after a trial, follow Apple's stated cancellation deadline.
- Refunds: Apple administers App Store refunds, eligibility, and payment disputes, subject to applicable law. Requests should be submitted through reportaproblem.apple.com.
- Restore purchases: eligible subscribers can use the app's restore-purchases function or Apple Account purchase history. Access may require the Apple Account used for the original purchase.
- Price changes: Apple provides required notice or requests consent where applicable. If you do not accept a price increase that requires consent, the subscription may expire at the end of the current period.
Nothing in these Terms limits mandatory cancellation, refund, conformity, or other consumer rights available under the law where you live.
8. Acceptable use
You may use the Service only for lawful, personal, non-commercial family use. Except where applicable law expressly permits it, you must not:
- Copy, sell, sublicense, rent, distribute, publicly perform, or commercially exploit the Service or its content.
- Reverse engineer, decompile, disassemble, bypass, or interfere with security, subscription, parental-gate, or access-control features.
- Use automated systems to extract content or attempt unauthorized access to the Service.
- Use BabyBrain in a way that endangers a child, violates another person's rights, or breaches applicable law.
- Misrepresent BabyBrain as medical treatment, professional therapy, formal assessment, or guaranteed developmental training.
9. Intellectual property
BabyBrain, its software, visual design, text, game structure, graphics, audio, logos, trademarks, and other original content are owned by or licensed to ARCHIMEDES.VISION and are protected by intellectual-property laws. These Terms grant only the limited right to use the Service; no ownership rights are transferred.
Apple, App Store, iPhone, and iPad are trademarks of Apple Inc. Apple does not sponsor or endorse BabyBrain.
10. Availability, updates, and feature changes
We may update the Service to improve safety, compatibility, accessibility, performance, or content. Individual games and features may change as the product develops. Availability can depend on device model, operating-system version, country, App Store status, and technical conditions.
We do not guarantee uninterrupted or error-free availability. We may suspend or discontinue all or part of the Service where reasonably necessary, subject to applicable law and any obligations owed to active subscribers. Device owners are responsible for compatible hardware, software updates, internet access needed for App Store functions, and associated charges.
11. Warranties and disclaimers
To the maximum extent permitted by applicable law, BabyBrain is provided "as is" and "as available". We do not make warranties that the Service will meet every family's needs, remain compatible with every device, operate without interruption or error, or produce a particular developmental or educational result.
Some jurisdictions do not allow certain warranty exclusions. Any mandatory statutory warranty or consumer guarantee that applies to you remains unaffected.
12. Limitation of liability
To the extent permitted by law, ARCHIMEDES.VISION is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of or inability to use the Service, loss of local progress data, device damage caused by misuse, or reliance on the Service as medical or professional advice.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer rights. Where liability may lawfully be limited, our aggregate liability relating to the Service will not exceed the greater of the amount you paid for BabyBrain during the preceding 12 months or the minimum amount required by applicable law.
13. Suspension and termination
You may stop using BabyBrain at any time and may cancel a subscription through Apple. Deleting the app does not itself cancel an active subscription.
We may restrict access where reasonably necessary to protect the Service, comply with law, address fraud or misuse, or respond to a serious breach of these Terms. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, and dispute provisions, will continue to apply.
14. Governing law and disputes
These Terms are governed by the laws of Greece, without regard to conflict-of-law rules. However, if you are a consumer, you retain the protection of mandatory consumer laws and the right to bring proceedings in any forum that cannot lawfully be excluded in your country of residence.
Before starting formal proceedings, please contact us so we can try to resolve the issue. Nothing in this section prevents either party from seeking urgent protective relief or using a competent consumer-protection or regulatory authority.
15. Changes to these terms
We may update these Terms to reflect changes to the Service, subscriptions, law, or safety requirements. We will update the effective date and provide additional notice where required. Material changes will not retroactively reduce mandatory rights or alter an already-paid subscription period except as permitted by law and Apple's rules.
If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Apple purchase terms, and the applicable Apple EULA form the agreement governing use of BabyBrain.
